Sub: Submission of returns of immovable property by non- gazetted Railway employees.

Attention of the Railways is drawn to Railway Ministry’s Decision No. 11 below rule 18 of Railway Services (Conduct) Rules, 1966 read with clarification issued vide Board’s letters No. E(D&A)2007 GS1- 1 dated 28.3.2008 and 17.6.2009, providing that Supervisory Staff of Group ‘C’ on Railways working in scales of pay the maximum of which is Grade pay of Rs. 4600 and above are required to submit an annual return regarding the immovable property inherited by him, or owned or acquired by him, or held by him on lease or mortgage, either in his own name or in the name of any member of his family or in the name of any other person. The return should be submitted within three months of his first appointment in the grade and thereafter in the month of January every year.

Railway Ministry’s Decision No. 12 also provides that certain categories of Commercial Staff in all grades, viz.- Reservation Clerks, Parcel Clerks, Booking Clerks,- TTE and TCs, should, besides submitting a property return on their initial appointment as required in Rule 18 (1) (i) of the Conduct Rules, should also submit a return of their property at the time of every promotion, as also at the time of submitting documents for pension (approximately two years prior to superannuation).

3. It has been observed that the above instructions are not being adhered to in letter and spirit.

4. The format for submitting IPRs by the relevant category of non-gazetted employees is enclosed. All Railways/PUs and other units may please ensure that the instructions referred above are scrupulously followed by the concerned Railway Servants working under their administration.

1.       रेलवे मंत्रालय के निर्णय संख्या 11, नियम 18 (रेलवे सेवा आचरण नियम, 1966) के अंतर्गत तथा बोर्ड के पत्र संख्या E(D&A)2007 GS1-1 दिनांक 28.03.2008 एवं 17.06.2009 के अनुसार यह प्रावधान है कि रेलवे पर कार्यरत ग्रुप ‘C’ के पर्यवेक्षी कर्मचारी, जिनका वेतनमान अधिकतम ₹4600 ग्रेड पे या उससे अधिक है, उन्हें अपनी अचल संपत्ति का वार्षिक विवरण प्रस्तुत करना आवश्यक है। इसमें वह संपत्ति शामिल होगी जो कर्मचारी ने विरासत में प्राप्त की हो, स्वयं के नाम पर खरीदी या अर्जित की हो, पट्टे या बंधक पर ली हो, या परिवार के किसी सदस्य अथवा अन्य व्यक्ति के नाम पर हो।

यह विवरण ग्रेड में प्रथम नियुक्ति के तीन माह के भीतर तथा उसके बाद हर वर्ष जनवरी माह में प्रस्तुत किया जाना चाहिए।

2.       रेलवे मंत्रालय के निर्णय संख्या 12 के अनुसार, कुछ वाणिज्यिक श्रेणी के कर्मचारी जैसे—आरक्षण क्लर्क, पार्सल क्लर्क, बुकिंग क्लर्क, टीटीई और टीसी—को प्रारंभिक नियुक्ति पर संपत्ति विवरण प्रस्तुत करने के अतिरिक्त प्रत्येक पदोन्नति के समय तथा पेंशन हेतु दस्तावेज जमा करते समय (सेवानिवृत्ति से लगभग दो वर्ष पूर्व) भी संपत्ति विवरण प्रस्तुत करना आवश्यक है।

4.       यह देखा गया है कि उपरोक्त निर्देशों का पालन अपेक्षित रूप से नहीं किया जा रहा है।

6.       गैर-राजपत्रित कर्मचारियों द्वारा अचल संपत्ति विवरण (IPR) प्रस्तुत करने का प्रारूप संलग्न है। सभी रेलवे/उत्पादन इकाइयाँ एवं अन्य इकाइयाँ यह सुनिश्चित करें कि उपरोक्त निर्देशों का पालन उनके प्रशासन के अंतर्गत कार्यरत रेलवे कर्मचारियों द्वारा सावधानीपूर्वक किया जाए।
