Delhi High Court on 29.04.2013 dismissed W.P.(C) 1535/2012 filed by GOI against PCAT Judgement dated 01.11.2011

Finally justice seems to have won

Dear Friends Finally, there is hope and justice seems to have won. Our case came up today in Delhi High Court before the Bench consisting of Justice Nanadrajog and Justice Kameshwar Rao. Shri S.B. Lal and I attended the hearing and our Advocate was personally present. Apparently the Bench had read our Counter and the Affidavit and straightaway started tackling the Government Advocate. The latter's half hearted pleadings to confuse the issue had no impact on the Bench. Seeing so many senior citizens, it was clear that the Bench was convinced about the injustice. Our Advocate clarified a few points.  While detailed verdict will be given in the next few days and it is our impression that GOI Writ has been dismissed. As soon as we get the detailed order, we propose to revive our Contempt petition in CAT to enforce the compliance of its 1-11-2011 verdict. In the meantime, this is for your information.

From the desk of Secy. General Bharat Pensioners Samaj

Friends, For some time one of the sister organization has been indulging in spewing venom against BPS. Perhaps those at the helm of affairs in that organization have lot of time & are feeling insecure. Friends, We will never reach our destination if we stop to throw stones on every dog that barks! So without indulging in blame game let us move ahead undeterred. Next decade is going to be of struggle not only for pensioners but for the entire community of     Sr Citizens and organizations will have to determine whether Co-operation is a better model or conflict is? We have already chosen the model of Co operation and have reached an understanding with NFRP Palghat, AIFPA Chennai , AISCCON Mumbai & Sr. Citizens Council Delhi to struggle  jointly & severally for the common issues viz: 1 Financial security (i.e.  In case of Pensioners, Retirement benefits inclusive of statuary Pension,   security of  pension & savings against  inflation & market risks). 2. HT explains the interest rate, price and growth linkage. What does the latest price data say about trends in India’s inflation rate? Food inflation stood at 8.73% in March, down from 11.38% in February, pulled down by lower vegetable prices.

Grant pension to ex-employee: CAT to Delhi govt

Grant pension to ex-employee: CAT to Delhi govt http://zeenews.india.com/news/delhi/grant-pension-to-ex-employee-cat-to-delhi-govt_842319.html
New Delhi: Observing that the aim of pension is to provide social security to government servants, the Central Administrative Tribunal has directed the Delhi government to grant pension to one of its former employees who was denied the benefit on the ground that he had resigned before completing 20 years in service. "The object of pension rules itself is to provide social security to government servants, by way of pension, but not to deny the same even to a dismissed, removed or compulsorily retired government servant," CAT member Ajay Kumar said.
The tribunal made the observations while deciding in favour of petitioner Amar Singh, a retired army personnel who had challenged the Delhi government's order rejecting his requests for pension.

After serving in the Army Medical Corps as Naik, Singh retired on March 24, 1986. On March 22, 19…
