Railway Services (Payment of Gratuity under National Pension System) Rules,
2025 have been notified in the Gazette of India vide G.S.R. 852(E) dated 14th
November, 2025. A copy of the same is enclosed for information, guidance and
compliance.

NOTIFICATION
New Delhi, the 14th November, 2025
G.S.R. 852(E).—
In exercise of the powers conferred by the proviso to article 309 ofthe
Constitution, the President hereby makes the following rules, namely:-
NPS investment options
CHAPTER I
1. Short title and
commencement.– (1) These rules may be called the Railway Services (Payment of
Gratuity under National Pension System) Rules, 2025.
(2) It shall be
deemed to have come into force on the 1st day of January, 2004.
2. Application.– Save as otherwise provided in these rules, these
rules shall apply to the railway servant appointed substantively to railway
services on or after the 1st day of January, 2004, and to whom the Railway
Services (Implementation of National Pension System) Rules, 2025 apply :
Provided that in
the case of a railway servant who dies during service or is boarded out on
account of disablement or retires on invalidation and who had exercised option
under rule 10 of the Railway Services (Implementation of National Pension
System) Rules, 2025 for availing benefits under the Railway Services (Pension)
Rules, 1993 or the Railway Services (Extraordinary Pension) Rules, 1993,
payment of gratuity shall be made in accordance with the said rules.
3. Definitions. – (1) In these rules, unless the context
otherwise requires, –
(a) “Accounts
Officer” means a Principal Financial Advisor of a Railway or such other
Officers as may be appointed in this behalf by the Railway Board;
(b) “allottee”
means a railway servant to whom railway or Government accommodation has been
allotted on payment of license fee or otherwise;
(c) “average
emoluments” means average emoluments as determined in accordance with rule 7;
(d) “Code” means
the Indian Railway Establishment Code;
(e) “Emoluments”
means emoluments referred to in rule 6;
(f) “Form” means a
Form appended to these rules ;
(g) “Government”
means the Central Government ;
(h) “Government
dues” means dues referred to in rule 45;
(i) “gratuity”
includes retirement gratuity and death gratuity payable under these rules;
(j) “Head of
office” means a Gazetted Officer whom the appointing authority may, by order
declare as Head of office and includes such other authority or person whom the
appointing authority may specify in the like manner;
(k) “Minor” means a
person who has not completed the age of eighteen years;
Pension fund comparison
(l) “qualifying
service” means the service rendered while on duty or otherwise which shall be
taken into account for the purpose of payment of gratuity admissible under
these rules;
(m) “railway
servant” means a person who is a member of a railway service or holds a post
under the administrative control of the Railway Board and includes a person who
is holding the post of Chairman and Chief Executive Officer, Member (Finance)
or a Member of the Railway Board, it does not include casual labour or person lent
from a service or post which is not under the administrative control of the
Railway Board to a service or post which is under such administrative control;
and
(n) ‘Service Book’
is a document (either in physical or electronic form) containing record of
service including service roll, if any.
(2) The words and
expressions used herein and not defined, but defined in the Code or the Railway
Services (Implementation of National Pension System) Rules, 2025, shall have
the same meanings as respectively assigned to them in those rules.

नई दिल्ली, दिनांक 14 नवम्बर, 2025
जी.एस.आर. 852(ई) — संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रपति निम्नलिखित नियम बनाते हैं, अर्थात् :—
अध्याय – I
1. संक्षिप्त नाम और प्रवर्तन
(1) इन
नियमों को रेलवे
सेवाएँ
(राष्ट्रीय
पेंशन
प्रणाली
के अंतर्गत ग्रेच्युटी का भुगतान) नियम, 2025 कहा जाएगा।
(2) ये नियम 1 जनवरी,
2004 से प्रवृत्त माने जाएँगे।
2. लागू
होने
की सीमा
इन
नियमों में अन्यथा प्रावधान किए जाने को छोड़कर, ये
नियम उन रेलवे सेवकों
पर लागू होंगे—
·
जिन्हें
1 जनवरी, 2004 या उसके बाद
रेलवे सेवाओं में नियमित रूप से नियुक्त किया
गया हो, और
·
जिन
पर रेलवे
सेवाएँ
(राष्ट्रीय
पेंशन
प्रणाली
का कार्यान्वयन) नियम, 2025 लागू होते हों।
परंतु, यदि कोई रेलवे सेवक सेवा के दौरान मृत्यु को प्राप्त हो जाता है, अथवा अपंगता के कारण सेवा से पृथक किया जाता है, अथवा अमान्यकरण के कारण सेवानिवृत्त होता है, और उसने रेलवे सेवाएँ (एनपीएस का कार्यान्वयन) नियम, 2025 के नियम 10 के अंतर्गत रेलवे सेवाएँ (पेंशन) नियम, 1993 अथवा रेलवे सेवाएँ (असाधारण पेंशन) नियम, 1993 के अंतर्गत लाभ लेने का विकल्प चुना हो, तो ऐसे मामलों में ग्रेच्युटी का भुगतान उन्हीं नियमों के अनुसार किया जाएगा।
3. परिभाषाएँ
(1) इन
नियमों में, जब तक संदर्भ
से अन्यथा अपेक्षित न हो,—
(a) “लेखा अधिकारी” से तात्पर्य किसी
रेलवे का प्रमुख वित्तीय
सलाहकार या ऐसा अन्य
अधिकारी है जिसे रेलवे
बोर्ड द्वारा इस हेतु नियुक्त
किया गया हो;
(b) “आवंटी” से तात्पर्य उस
रेलवे सेवक से है जिसे
रेलवे या सरकारी आवास
लाइसेंस शुल्क पर या अन्यथा
आवंटित किया गया हो;
(c) “औसत वेतन” से तात्पर्य नियम
7 के अनुसार निर्धारित औसत वेतन से है;
(d) “संहिता” से तात्पर्य भारतीय
रेलवे स्थापना संहिता से है;
(e) “वेतन” से तात्पर्य नियम
6 में उल्लिखित वेतन से है;
(f) “प्रपत्र” से तात्पर्य इन
नियमों के साथ संलग्न
प्रपत्र से है;
(g) “सरकार” से तात्पर्य केंद्रीय
सरकार से है;
(h) “सरकारी देयताएँ” से तात्पर्य नियम
45 में उल्लिखित देयताओं से है;
(i) “ग्रेच्युटी” में सेवानिवृत्ति ग्रेच्युटी एवं मृत्यु ग्रेच्युटी दोनों सम्मिलित हैं;
(j) “कार्यालय प्रमुख” से तात्पर्य उस
राजपत्रित अधिकारी से है जिसे
नियुक्ति प्राधिकारी द्वारा कार्यालय प्रमुख घोषित किया गया हो, तथा इसमें ऐसा अन्य अधिकारी या व्यक्ति भी
शामिल है जिसे नियुक्ति
प्राधिकारी द्वारा निर्दिष्ट किया गया हो;
(k) “नाबालिग” से तात्पर्य ऐसे
व्यक्ति से है जिसने
अठारह वर्ष की आयु पूर्ण
नहीं की हो;
(l) “योग्य सेवा” से तात्पर्य उस
सेवा से है जिसे
ड्यूटी पर या अन्यथा
रहते हुए प्रदान किया गया हो और जिसे
इन नियमों के अंतर्गत ग्रेच्युटी
के भुगतान के प्रयोजन हेतु
गणना में लिया जाएगा;
(m) “रेलवे सेवक” से तात्पर्य ऐसे
व्यक्ति से है जो
किसी रेलवे सेवा का सदस्य हो
या रेलवे बोर्ड के प्रशासनिक नियंत्रणाधीन
किसी पद पर कार्यरत
हो; इसमें रेलवे बोर्ड के अध्यक्ष एवं
मुख्य कार्यकारी अधिकारी, सदस्य (वित्त) अथवा रेलवे बोर्ड के सदस्य भी
सम्मिलित हैं;
परंतु इसमें आकस्मिक श्रमिक या ऐसे व्यक्ति
शामिल नहीं हैं जिन्हें किसी अन्य सेवा से अस्थायी रूप
से रेलवे बोर्ड के प्रशासनिक नियंत्रणाधीन
पद पर भेजा गया
हो;
(n) “सेवा पुस्तिका” से तात्पर्य उस
दस्तावेज़ से है (भौतिक
या इलेक्ट्रॉनिक रूप में) जिसमें सेवा का विवरण दर्ज
हो, जिसमें सेवा रोल भी सम्मिलित हो
सकता है।
(2) इन नियमों में प्रयुक्त किंतु परिभाषित न किए गए शब्द एवं अभिव्यक्तियाँ, जो संहिता या रेलवे सेवाएँ (राष्ट्रीय पेंशन प्रणाली का कार्यान्वयन) नियम, 2025 में परिभाषित हैं, वही अर्थ रखेंगी जो उन्हें उन नियमों में दिए गए हैं।
