OFFICE MEMORANDUM

Subject : Settlement of Family Pension between two wives of a Government Servant or Pensioner under Central Civil Services (Pension) Rules, 2021 reg.

The undersigned is directed to refer to this Department’s O.M. of even number dated 10.10.2024. As stated earlier, the Department of Pension and Pensioners’ Welfare (DoPPW) has notified the Central Civil Services (Pension) Rules, 2021] and Rule 50 of the Central Civil Services (Pension) Rules, 2021 deals with payment of family pension on death of a Government servant/pensioner.

2. In accordance with Rule 50 (6) of the CCS (Pension) Rules, 2021, the family pension shall be payable to the members of the family of the deceased Government servant or pensioners in the following order: –

i.  Subject to provisions of sub-rule (8), widow or widower, (including a post-retiral spouse and judicially separated wife or husband).

ii. Subject to provisions of sub-rule (9), children (including adopted children, step children and children born after retirement of the pensioner).

iii. subject to provisions of sub-rule (10), dependent parents (including adoptive parents) of the deceased Government servant or pensioner,

iv.  subject to provisions of sub-rule (11), dependent siblings (i.e. brother or sister) of the deceased Government servant or pensioner, suffering from a mental or physical disability

3. Whereas the Explanation to Rule 50(6) (1) of the CCS (Pension) Rules, 2021 states that – For the purpose of this rule ‘widow’ and ‘widower’ shall mean a spouse, legally wedded to the deceased Government servant or the pensioners.

4. Whereas Rule 50(8)(c) of the CCS (Pension) Rules, 2021 states that-

Where the deceased Government servant or pensioner is survived by more widow than one, the family pension shall be paid to the widows in equal shares and on the death or ineligibility of a widow. her share of the family pension shall become payable to her child or children who fulfil the eligibility conditions mentioned in sub-rule (9).

5. The position with reference to the legality of marriage / spouse was clarified. However, this Department still receives many references seeking clarification on these points. In order to avoid lime in decision making, the rule position is re-iterated. Having second wife when the first wife is alive is against the provisions of Hindu Marriage Act, 1955 and also contradictory to the provisions of CCS (Pension) Rules, 2021. For the administrative authority, it is very important to have application of mind while examining such cases and interpreting the Rules. For any disputes arising out of them, the replies / briefs for the tribunals / courts need to be suitably prepared in accordance with the provisions of CCS (Pension) Rules and extant guidelines.

6. All Ministries/Departments are requested to follow the process of consultation with Department of Legal Affairs before arriving at decision regarding Settlement of Family Pension between two wives under Central Civil Services (Pension) Rules, 2021. Such cases must be brought to the notice of the officer dealing with the pensioners’ benefits in the respective Ministry/Department by the attached’subordinate offices etc.

विषय : केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 के अंतर्गत किसी सरकारी सेवक या पेंशनर की दो पत्नियों के बीच पारिवारिक पेंशन के निपटान के संबंध में।

अधोहस्ताक्षरी यह विभाग के दिनांक 10.10.2024 के इसी संख्या के पूर्व जारी कार्यालय ज्ञापन की ओर ध्यान आकर्षित करता है। जैसा कि पूर्व में बताया गया है, पेंशन एवं पेंशनभोगी कल्याण विभाग द्वारा केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 अधिसूचित किए गए हैं, और इन नियमों का नियम 50 किसी सरकारी सेवक / पेंशनर की मृत्यु पर पारिवारिक पेंशन के भुगतान से संबंधित है।

2. नियम 50(6) के अनुसार पारिवारिक पेंशन का क्रम इस प्रकार है :

i. उप-नियम (8) के प्रावधानों के अधीन — विधवा या विधुर (सेवानिवृत्ति उपरांत विवाह किए गए जीवनसाथी तथा न्यायालय द्वारा पृथक पत्नी/पति सहित)
ii. उप-नियम (9) के प्रावधानों के अधीन — संतान (दत्तक संतान, सौतेले बच्चे, तथा पेंशनर के सेवानिवृत्ति के बाद जन्मे बच्चे सहित)
iii. उप-नियम (10) के प्रावधानों के अधीन — आश्रित माता-पिता (दत्तक माता-पिता सहित)
iv. उप-नियम (11) के प्रावधानों के अधीन — आश्रित दिव्यांग भाई/बहन

3. नियम 50(6)(1) की व्याख्या

इस नियम के उद्देश्य से ‘विधवा’ और ‘विधुर’ का अर्थ है — मृत सरकारी सेवक या पेंशनर से विधिवत रूप से विवाह किया हुआ जीवनसाथी।

4. नियम 50(8)(c) के अनुसार :

यदि मृत सरकारी सेवक / पेंशनर की एक से अधिक विधवाएँ जीवित हैं तो —

·         पारिवारिक पेंशन दोनों/सभी विधवाओं को समान अंशों में दी जाएगी।

·         किसी एक विधवा की मृत्यु या अयोग्यता की स्थिति में, उसका हिस्सा उसके पात्र बच्चों को दिया जाएगा।

5. दूसरी पत्नी की वैधता संबंधी स्थिति :

कई मंत्रालयों/विभागों से अब भी इन मुद्दों पर स्पष्टीकरण मांगे जा रहे हैं। नियमों की पुनः पुष्टि करते हुए स्पष्ट किया जाता है कि —

·         पहली पत्नी के जीवित रहते हुए दूसरी शादी करना,
हिंदू विवाह अधिनियम, 1955 तथा केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 दोनों के विपरीत है।

·         अतः विभागीय प्राधिकरण को ऐसे मामलों की जांच करते समय विशेष सावधानी और नियमों का उचित अनुपालन करना आवश्यक है।

·         ऐसे मामलों से संबंधित विवादों हेतु न्यायाधिकरणों/अदालतों में प्रस्तुत किए जाने वाले अभ्यावेदन/उत्तर विद्यमान नियमों के अनुरूप तैयार किए जाएँ।

6. मंत्रालयों/विभागों को परामर्श प्रक्रिया का पालन :

सभी मंत्रालयों / विभागों से अनुरोध है कि —

·         ऐसी परिस्थितियों में निर्णय लेने से पूर्व कानूनी कार्य विभाग (Department of Legal Affairs) से परामर्श अवश्य करें।

·         अधीनस्थ कार्यालयों द्वारा ऐसे मामलों को संबंधित मंत्रालय/विभाग के पेंशन मामलों के प्रभारी अधिकारी के संज्ञान में लाया जाए।

7. यह आदेश सक्षम प्राधिकारी की स्वीकृति से जारी किया गया है।
