OFFICE MEMORANDUM

विषय : Clarification regarding coverage of offices for payment of gratuity to the Central Government Servant under Central Civil Services (Pension) Rules, 2021 Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021.

The undersigned in directed to refer the subject mentioned above and to state that the Department of Pension and Pensioners’ Welfare (DoPPW) had issued OM No. 28/03/2024-P&PW(B)’Gratuity/9559 dated 30.05.2024 enhancing the maximum limit of the gratuity from Rs. 20 lakhs to Rs. 25 lakhs to the central government civilian employees covered under Central Civil Services (Pension) Rules, 2021 and the Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021.

 2. DoPPW, however, keeps receiving references/RTI applications etc seeking clarification whether the above referred OM/payment of gratuity under CCS (Pension) Rules is applicable on societies, banks, ports trusts, RBI, PSU, autonomous bodies, Universities State Governments etc and if not under which rules these organisations are governed.

3. It is stated that Department of Pension & Pensioners’ Welfare (DoPPW) is the nodal Department for formulation of policies relating to pension and other retirement benefits of Central Government civil employees covered under the Central Civil Services (Pension) Rules, 2021 and Central Civil Services (Payment of Gratuity under National Pension System) Rules, 2021. These rules are not applicable on types of organisations as mentioned in para 2 above. It is further stated that any query on the subject including one i.e. under which rules such organisations are governed should be addressed to the concerned organisation / concerned administrative Ministry/Department.

4. The contents of this Office Memorandum may please be given wide publicity and brought to the notice of all concerned.

5. This issues with the approval of competent authority.

विषय :- केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 तथा केंद्रीय सिविल सेवा (राष्ट्रीय पेंशन प्रणाली के अंतर्गत ग्रेचुइटी भुगतान) नियम, 2021 के अंतर्गत केंद्रीय सरकारी कर्मचारियों को ग्रेचुइटी भुगतान हेतु कार्यालयों की कवरेज के संबंध में स्पष्टीकरण।

1.   उपरोक्त विषय का संदर्भ लेते हुए यह स्पष्ट किया जाता है कि पेंशन एवं पेंशनभोगी कल्याण विभाग (DoPPW) ने कार्यालय ज्ञापन सं. 28/03/2024-P&PW(B) ‘Gratuity’/9559 दिनांक 30.05.2024 जारी किया था, जिसके माध्यम से केंद्रीय सरकारी सिविल कर्मचारियों—जो केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 अथवा केंद्रीय सिविल सेवा (राष्ट्रीय पेंशन प्रणाली के अंतर्गत ग्रेचुइटी भुगतान) नियम, 2021 के अंतर्गत आते हैं—के लिए अधिकतम ग्रेचुइटी सीमा ₹20 लाख से बढ़ाकर ₹25 लाख कर दी गई थी।

 

2.   इसके बावजूद, DoPPW को यह पूछते हुए कई संदर्भ/RTI आवेदन प्राप्त हो रहे हैं कि—क्या उपर्युक्त OM / CCS (Pension) Rules के अंतर्गत ग्रेचुइटी भुगतान
समितियों (Societies), बैंकों, पोर्ट ट्रस्ट, RBI, PSU, स्वायत्त निकायों, विश्वविद्यालयों, राज्य सरकारों आदि पर लागू होता है? और यदि नहीं, तो ऐसे संगठनों पर कौन से नियम लागू होते हैं?

 

3.   इस संबंध में यह स्पष्ट किया जाता है कि:

·         DoPPW केंद्रीय सिविल कर्मचारियों के पेंशन एवं अन्य सेवानिवृत्ति लाभों से संबंधित नीतियों के निर्माण का नोडल विभाग है।

·         DoPPW की अधिसूचित नियमावली केवल इन पर लागू होती है:

o    केंद्रीय सिविल सेवा (पेंशन) नियम, 2021

o    केंद्रीय सिविल सेवा (राष्ट्रीय पेंशन प्रणाली के अंतर्गत ग्रेचुइटी भुगतान) नियम, 2021

❗उपरोक्त नियम para 2 में उल्लिखित संस्थाओं पर लागू नहीं होते—

जैसे: Societies, Banks, RBI, Port Trusts, PSU, Autonomous Bodies, Universities, State Governments आदि।

अतः यह स्पष्ट किया जाता है कि ऐसे संगठनों से संबंधित किसी भी प्रकार का प्रश्न—विशेषकर यह कि वे किस नियम के अंतर्गत संचालित होते हैं—का उत्तर संबंधित संगठन अथवा उसके प्रशासनिक मंत्रालय/विभाग से ही प्राप्त किया जाना चाहिए।

4.   इस कार्यालय ज्ञापन की विषय-वस्तु को व्यापक प्रचार दिया जाए और सभी संबंधित कार्यालयों के संज्ञान में लाया जाए।

5.   यह आदेश योग्य प्राधिकारी की स्वीकृति से जारी किया जाता है।
