Subject:
Counting of periods spent on leave under the Central Civil Service (Pension)
Rules, 2021.
The undersigned is directed to say that Department of Pension
and Pensioners’ Welfare has notified the Central Civil Service (Pension) Rules,
2021 in supersession of the Central Civil Service (Pension) Rules, 1972.
2. In accordance with Rule 21
of the Central Civil Service (Pension) Rules, 2021, and this Department OM
No. 28/90/2022 P&PVV(B)/8297 Dated 2nd October, 2022, it is
stated that in the case of extraordinary leave other than extraordinary leave
granted on medical certificate and extraordinary leave allowed to be counted as
qualifying service under proviso to this rule, at the time of grant of such
leave, a definite entry shall be made in the service book of the Government
servant to the effect that the period of extraordinary leave shall not be
treated as qualifying service and such an entry in the service book, if not
made at the time of grant of extraordinary leave, can be made subsequently but
not later than six months before the date of retirement of the Government
servant on superannuation and if no such entry is made in the service book, the
period of extraordinary leave shall be treated as qualifying service.
3. All Ministries/Departments are requested that the above
provisions regarding Counting of periods spent on leave under the Central Civil
Service (Pension) Rules, 2021 may be brought to the notice of the personnel
dealing with the pensionary benefits in the Ministry/Department and
attached/subordinate offices thereunder, for strict implementation.

विषय: केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 के अंतर्गत अवकाश की अवधि की गणना के संबंध में।
1. अधोहस्ताक्षरी को यह कहते हुए निर्देशित किया गया है कि पेंशन एवं पेंशनभोगी कल्याण विभाग द्वारा केंद्रीय सिविल सेवा (पेंशन) नियम, 1972 को प्रतिस्थापित करते हुए केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 अधिसूचित किए जा चुके हैं।
2. नियम 21 — असाधारण अवकाश (Extraordinary Leave) की गणना के संबंध में
केंद्रीय
सिविल सेवा (पेंशन) नियम, 2021 के नियम 21,
तथा इस विभाग के
OM संख्या 28/90/2022-P&PW(B)/8297 दिनांक 2 अक्टूबर, 2022 के अनुसार, यह
स्पष्ट किया जाता है कि—
(A) किन मामलों में असाधारण अवकाश (EOL) अर्हक सेवा में नहीं गिना जाएगा:
नीचे
दिए गए मामलों को
छोड़कर—
·
चिकित्सा प्रमाणपत्र के आधार पर दिया गया असाधारण अवकाश,
·
तथा
·
ऐसा असाधारण अवकाश जिसे नियम के प्रावधान अनुसार अर्हक सेवा में शामिल करने की अनुमति दी गई हो,
इनके
अतिरिक्त अन्य
सभी
असाधारण
अवकाश
की अवधि अर्हक सेवा (Qualifying Service) में नहीं जोड़ी जाएगी।
(B) सेवा पुस्तिका में प्रविष्टि आवश्यक
ऐसे
असाधारण अवकाश को स्वीकृत करते
समय, कार्यालय प्रमुख द्वारा सेवा पुस्तिका में निम्नलिखित स्पष्ट प्रविष्टि करना अनिवार्य है—
“यह असाधारण अवकाश की अवधि अर्हक सेवा नहीं मानी जाएगी।”
(C) प्रविष्टि कब तक की जा सकती है
यदि
यह प्रविष्टि अवकाश स्वीकृति के समय न
की गई हो, तो
इसे—
✔ बाद
में भी किया जा
सकता है,
✘
परंतु सेवानिवृत्ति
(superannuation) से
छह माह पहले तक ही।
(D) यदि प्रविष्टि नहीं की गई हो तो—
यदि
सेवा पुस्तिका में उपरोक्त प्रविष्टि नहीं की गई है,
तो—
✔ उस अवधि की असाधारण अवकाश को अर्हक सेवा माना जाएगा।
3. सभी मंत्रालयों/विभागों के लिए निर्देश
सभी
मंत्रालयों/विभागों से अनुरोध है
कि—
केंद्रीय सिविल सेवा (पेंशन) नियम, 2021 के अंतर्गत अवकाश की अवधि की गणना से संबंधित उपरोक्त प्रावधानों को मंत्रालय/विभाग तथा उसके अधीनस्थ/संलग्न कार्यालयों में पेंशन कार्य संभालने वाले सभी कार्मिकों के संज्ञान में लाया जाए, ताकि इनका कड़ाई से पालन सुनिश्चित किया जा सके।
