Subject: Guidelines for allowing medical facilities under CGHS/CS(MA) Rules, 1944, to dependent transgender children/siblings irrespective of age — Reg.

In compliance with the provisions of the Transgender Persons (Protection of Rights) Act, 2019, it has been decided to allow medical facilities under CGHS/CS(MA) Rules, 1944, to dependent transgender children/siblings of Central Government employees (serving/pensioner) irrespective of age, subject to the following conditions:

• Individual must be wholly dependent as per the financial limit specified in MoHFW OM No. per OM No. $.11012/2/2016-CGHS(P) dated 08.11.2016 (copy enclosed), on the central government employee.
• Individual must have a certificate issued by District Magistrate, under the provisions of Transgender Persons (Protection of Rights) Act, 2019.
• 2. This issues with the approval of competent authority.

  विषय: आश्रित ट्रांसजेंडर बच्चों/भाई-बहनों को आयु की परवाह किए बिना सीजीएचएस/सीएस(एमए) नियम, 1944 के अंतर्गत चिकित्सीय सुविधाएँ प्रदान करने के संबंध में।

  ट्रांसजेंडर व्यक्तियों (अधिकारों का संरक्षण) अधिनियम, 2019 के प्रावधानों के अनुपालन में यह निर्णय लिया गया है कि केंद्रीय सरकारी कर्मचारियों (सेवारत/पेंशनभोगी) के आश्रित ट्रांसजेंडर बच्चे/भाई-बहनों को, आयु की परवाह किए बिना, सीजीएचएस/सीएस(एमए) नियम, 1944 के अंतर्गत चिकित्सीय सुविधाएँ दी जाएँगी, बशर्ते कि निम्नलिखित शर्तें पूरी हों:

  1. व्यक्ति पूरी तरह से आश्रित हो, जैसा कि वित्तीय सीमा में निर्दिष्ट किया गया है (स्वास्थ्य एवं परिवार कल्याण मंत्रालय के ओएम सं. S.11012/2/2016-CGHS(P) दिनांक 08.11.2016 के अनुसार – प्रति संलग्न)।

  2. व्यक्ति के पास जिला मजिस्ट्रेट द्वारा जारी किया गया प्रमाणपत्र हो, जो ट्रांसजेंडर व्यक्तियों (अधिकारों का संरक्षण) अधिनियम, 2019 के प्रावधानों के अंतर्गत जारी किया गया हो।

  3. यह आदेश सक्षम प्राधिकारी की स्वीकृति से जारी किया जाता है।
