ORDER

HONBLE DR. BRAHM A. AGRAWAL, MEMBER(J):-

The above four O.As. are being disposed of by this common Order, as the legal issue involved in all of them is the same.

2.1 The 133 applicants in the first three O.As., either themselves or their husbands were Master Craftsmen or Chargemen or Head Clerks in the employ of Northern Railway in Jagadhri Workshop, District Yamuna Nagar (Haryana), who all retired before 01.01.1996, i.e., the date of effect of the recommendations of the V Central Pay Commission. Their pay-scale before the said date was Rs. 1400-2300/-. Their pension w.e.f. 01.01.1996 was revised taking the corresponding pay-scale as Rs. 5000-8000/-, which is sought to be re-revised taking the corresponding pay-scale as Rs. 4500-7000/-, vide the Railway Boards letter dated 18.03.2010; this also had its effect on revision of pension w.e.f. 01.01.2006, i.e., the date of effect of the recommendations of the VI Central Pay Commission.

2.2 The applicant in the last O.A. retired as a Mistri in Jagadhri Workshop on 31.07.1996. His pay-scale was Rs. 1400-2300/- +Rs. 100 as special pay. The corresponding pay-scale was Rs. 4500-7000/- w.e.f. 01.01.1996 and his pension fixed accordingly. He seeks revision of his pension w.e.f. 01.11.2003 on the basis of revised pay-scale of Rs. 5000-8000/-, because w.e.f. the said date equivalents of his became Junior Engineers-II, on restructuring, in the pay-scale of Rs. 5000-8000/-.

3.1 All the first three O.As., dismissed by this Tribunal, vide its Orders dated 14.12.2012, 11.01.2013 and 09.04.2014, respectively, are before us on remand from the Honble High Court of Punjab and Haryana, vide its identical Decisions dated 29.01.2015. The one in the first O.A. reads as under:

For the reasons stated in our order of even date passed in CWP No.8563 of 2014 & other connected cases titled as Union of India vs. Darshan Lal Bali & others we are satisfied that the matter requires reconsideration by the Tribunal.

Consequently, the order dated 14.12.2012 (Annexure P-17) is set aside and the case is remitted to the Central Administrative Tribunal, Chandigarh Bench, Chandigarh, for fresh adjudication keeping in view the order passed by us in the above-said case.

3.2 The last O.A. is virgin.

4. We have heard the learned counsel for the parties, perused the pleadings as well as the rulings cited at the Bar, and given our careful consideration to the matter.

5. The Decision of the Honble High Court passed on 29.01.2015 in CWP No. 8563 of 2014 and connected cases titled as UOI Vs. Darshan Lal Bali & Ors upheld the claim of the applicants in the relevant O.As. before the Tribunal, relying on its own earlier Decision dated 24.08.2011 in CWP No. 9581-CAT of 2011 titled as Agia Ram & Ors. Vs. UOI & Ors.

6. Certain extracts from the Honble High Courts Decision in Agia Ram are reproduced hereunder:

3. A perusal of the aforesaid letter would show that the post of Supervisor/ erstwhile Mistry in the pay scale of 4500-7000 + 100 special allowance has been upgraded to the post of Junior Engineer-II in the pay scale of 5000-8000. The effect of restructuring was that the nomenclature of the post of Mistry-cum-Supervisor had undergone change and it came to be known as Junior Engineer-II in the pay scale of 5000-8000/

From the aforesaid facts, it is clear that the post of Mistry-cum-Supervisor has acquired new name of Junior Engineer-II, which was also in the same scale of 1400- 2300, in the pre-revised pay scale. However, the case of the respondent was that on the restructuring the pay scale granted to the post of Junior Engineer-II would be available only to the Mistry-cum-Supervisor who are working as such and has enjoyed the designation of Junior Engineer II.

Having heard learned counsel for the parties, we are of the considered view that once the post of Mistri-cum-Supervisor has acquired a new nomenclature and it has also been given higher scale of pay then the cosmetic cover which has been put forward by the respondent cannot be permitted to hide the real face of the erstwhile Mistri/ supervisor. For all instants and purposes, they would all be treated as Junior Engineer-II. Once the pay scale of the post of Mistri/ supervisor is deemed to be revised then their pension is also required to be re-fixed w.e.f. 1.11.2003.

6. As a sequel to the above discussion, the writ petition is allowed. The judgment of the Tribunal is set aside. It is directed that respondents shall re-fix the pay of the petitioners in the pay scale of 5000-8000 by treating them under new nomenclature given to the post of Mistry-cum-Supervisor i.e. Junior Engineer-II. Accordingly, their pension be revised w.e.f. 01.11.2003. However, arrears of pension shall be confined to three years from the date preceding the date of filing of the original application i.e. November, 2009.

7. Now, it will be apt to note the following extracts from the Honble High Courts Decision in Darshan Lal Bali:

[15]. We have given our thoughtful consideration to the rival submissions and perused the record. The Competent Authority can undoubtedly classify the retirees for the purpose of admissibility of retiral or other incidental benefits by fixing the cut-off date under a new Pension Scheme save that such classification is reasonable and can sustain the rigours of other Constitutional provisions. But such a recourse to divide the retirees in two groups may not be permissible while granting the benefits under a liberalised Pension Scheme (Re: V. Kasturi vs. Managing Director, State Bank of India, Bombay & Anr. (1998) 8 SCC 30). These principles need not be elaborated further as the point in issue appears to be slightly different.

[16]. Suffice to say that the above summarised principle(s) will not be applicable in the instant case for more than one reason. Firstly, in Agia Ram's case (supra) this Court was conscious of the fact that some of the writ-petitioners had retired before the Circular came into force yet after taking notice of that fact, they were held entitled to upgradation of their post(s) for upward revision of retiral benefits. The benefit of refixation or consequential revision of pension was, therefore, restricted only from the date the Circular came into force on 01.11.2003. Secondly, this Court did not give any retroactive effect to the Circular to relate it back to the date when the writ-petitioners retired from service on attaining the age of superannuation. Thirdly and most importantly, the petitioner(s) themselves took a categoric stand before the Hon'ble Supreme Court on 27.09.2012 (Annexure A-3) and 'instructed' their Ld. counsel to make a statement that the Authorities were willing to implement the order dated 24.08.2011 passed by this Court in Agia Ram's case.

[17]. Having taken a conscious decision to implement the decision of this Court in Agia Ram's case (supra) and after granting the resultant benefits to some of the writ-petitioners who were admittedly pre-1996 retirees, the question that arises for consideration is whether the petitioner-Authorities can deny the same benefit to other similarly placed persons only on the ground that the left out pre-1996 retirees had not earlier approached the Tribunal or this Court?

[18]. The petitioner(s) cannot, in our considered view, restrict the benefit of their decision qua those pre-1996 retirees only who were parties before this Court in Agia Ram and others' case (supra). Once the petitioner(s) acknowledged that the decision in Agia Ram and others' case has laid down correct statement of law, they are obligated to extend the benefit of their such voluntary decision uniformly qua all the pre-1996 retirees.

[20]. The petitioner(s) are a welfare State. They cannot and ought not to expect the respondent-retirees to roam in the corridors of Courts. The conscious decision taken by the petitioner(s) to extend benefit of their 2003 Circular to a batch of pre-1996 retirees amounts to shift in their policy, therefore, also the respondents being similarly placed retirees, are entitled to the benefit of revised Policy decision, even if such decision has emanated out of the command issued by this Court in Agia Ram and others' case. The denial of benefit of revised higher pension etc. to the respondents when it stands granted to other similarly placed retirees, certainly does violence to Articles 14 and 16 of the Constitution.

[21]. Since the Tribunal vide its orders dated 19.11.2013 (Annexure P-3), 10.10.2013 (Annexure P-1), 11.02.2014 & 08.07.2014 (Annexures P-3 & P-4) respectively, has directed what the petitioner(s) ought to have themselves volunteered, we do not find it a fit case to interfere with the impugned orders. However, keeping in view the facts and circumstances, petitioner(s) are granted three months time to give effect to the orders passed by the Tribunal.

[22]. Ordered accordingly.

8. While the learned counsel for the applicants contends that this Tribunal has now no option but to grant the claim of the applicants, the contention of the learned counsel for the respondents is that the Honble High Courts Decision in Agia Ram, on which is based its Decision in Darshan Lal Bali, is per incuriam.

9. We are of the view that the aforesaid contention of the learned counsel for the respondents is without substance and is also against the principles of judicial discipline.

10. Therefore, following the above Decisions of our jurisdictional High Court, the applicants are held entitled to their respective claims regarding fixation of their pension with reference to the pay-scale of Rs. 5000-8000. The arrears due to them shall be released within three months from the date of receipt of a copy of this Order.

11. The O.As. are allowed accordingly. No order as to costs.
