Learned counsel for the petitioners informs that the Punjab and Haryana, Kerala, Allahabad, and Jammu and Kashmir High Courts have already granted interim protection to the petitioners/pensioners, wherein similar kind of provision is the subject matter of challenge.

Considering the orders of these Courts in:

  • CW.P. No. 16320 of 2024,
  • WP(C) No. 22753 of 2024 (T),
  • Writ-A No. 12596 of 2024, and
  • WP(C) No. 2199 of 2024,

respectively, the Court orders that till the next date of hearing, no recovery shall be made from the commuted pension of the petitioners without leave of the Court. A counter is to be filed within three weeks.

The case is listed with W.P. No. 26042 of 2024 and the batch on 11.12.2024 for analogous hearing.


It is informed that, aggrieved by similar impugned orders/action, a sizeable number of petitions are being filed by retired Government employees. Every day, a few new similar cases come up against the same orders. The impugned order/action is the same in all these matters. In the fitness of things, the Court deems it proper to pass an order in rem by directing the respondents to extend similar interim protection, which is being provided today to all similarly situated retired State Government employees, whether or not such similarly situated retired State Government employees filed petitions. They shall be entitled to similar interim protection.

A copy of this order is to be provided to the learned Government Counsel with a request to communicate this order to all the concerned authorities for its strict implementation.
